Terms of Use

1. Acceptance

By creating an account or using CaseDocket, you accept these Terms of Use and our Privacy Policy. If you do not agree, do not use the service.

2. Service description

CaseDocket is an AI-assisted legal research and document drafting tool focused on South African law. CaseDocket is not a legal practitioner, is not a substitute for qualified legal advice, and does not create an attorney-client relationship.

3. Eligibility

You must be 18 years or older and legally capable of contracting in South Africa.

4. Your account

You are responsible for the accuracy of the details you provide, for keeping your password secure, and for all activity under your account. You may not share your account with anyone else.

5. Acceptable use

  • Do not upload material you have no right to use.
  • Do not use the service to harass, defame, or harm others.
  • Do not attempt to extract, copy, or reverse-engineer the underlying AI models.
  • Do not scrape or automate access without our written consent.

6. Your content

You retain all ownership rights in the documents you upload and the drafts you create. You grant CaseDocket a limited, non-exclusive licence to process that content solely to provide the service to you.

7. AI-generated output

  • Output is generated by AI from your inputs and may contain errors, omissions, outdated law, or hallucinations.
  • You are solely responsible for reviewing all output before using or relying on it.
  • CaseDocket makes no warranty that any draft or research result is legally correct, complete, or fit for any particular purpose.

8. No legal advice

Output produced by CaseDocket is legal information, not legal advice. You must consult a qualified South African attorney for advice on your specific situation.

9. Third-party content

Research results may link to third-party sources such as SAFLII, gov.za, and other publishers. CaseDocket does not control and does not warrant the accuracy or availability of third-party content.

10. Fees and billing

The service is currently free during beta. Commercial terms will be added before general launch and you will be notified before any fees apply.

11. Termination

Either party may terminate at any time. On termination, you may request export or deletion of your data as described in the Privacy Policy.

12. Disclaimers and limitation of liability

  • The service is provided “as is” and “as available”.
  • To the fullest extent permitted by South African law (including the Consumer Protection Act 68 of 2008), all warranties are disclaimed.
  • CaseDocket’s aggregate liability for any claim is limited to fees paid in the 12 months prior, or R1,000, whichever is higher.
  • We exclude indirect, consequential, special, and punitive damages to the extent permitted by law.
  • Nothing in these terms limits liability that cannot be limited by law (gross negligence, willful misconduct, CPA non-excludables).

13. Indemnity

You indemnify CaseDocket against claims arising from your misuse of the service, breach of these terms, or use of any output without independent professional review.

14. Governing law

These terms are governed by the laws of the Republic of South Africa.

15. Dispute resolution

The parties will first attempt to resolve disputes by good-faith negotiation, then by mediation, and failing that submit to the jurisdiction of the South African courts, with the Western Cape High Court (Cape Town) as the appropriate division.

16. General

If any provision is unenforceable, the rest remain in force. These terms are the entire agreement between you and us about the service. No failure to enforce any right is a waiver of it. You may not assign these terms without our consent.
